Smith’s Charges Against Trump Could Include Potential Death Penalty If He’s Convicted

Special Counsel Jack Smith on Tuesday indicted former President Donald Trump for his involvement in the campaign to contest the results of the 2020 presidential election on a number of serious offenses, including one for which the death sentence may be applied.

18 U.S.C. 241, “Conspiracy Against Rights,” carries a sentence of up to 10 years in federal prison, as reported by Breitbart’s Joel Pollak.

The statute adds that the offender may be executed if death results from the actions covered by this provision:

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or

If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured—

They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

According to Fox News, “This is the second federal indictment the former president faces out of Smith’s investigation. Trump, who leads the 2024 GOP presidential primary field, has already pleaded not guilty to 37 counts related to his alleged improper retention of classified records from his presidency.”

Trump faces several charges in that probe, including willful retention of national defense information, conspiracy to obstruct justice, and false statements. Additionally, he was indicted on three additional counts as part of a superseding indictment issued in connection with the same investigation last week.

This is the second time in U.S. history that a former president has faced charges in a federal criminal probe.

“This is nothing more than the latest corrupt chapter in the continued pathetic attempt by the Biden Crime Family and their weaponized Department of Justice to interfere with the 2024 Presidential Election, in which President Trump is the undisputed frontrunner, and leading by substantial margins,” a Trump campaign spokesperson told Fox News Digital.

“President Trump has always followed the law and the Constitution, with advice from many highly accomplished attorneys,” the spokesperson continued. “These un-American witch hunts will fail and President Trump will be re-elected to the White House so he can save our Country from the abuse, incompetence, and corruption that is running through the veins of our Country at levels never seen before.”
