The Supreme Court’s investigation found something terrible, Roe v. CNN reported that document security at the Supreme Court was minimal and contained so-called “bun bags” that were simply left in hallways.
In an investigation last month, CNN Supreme Court reporter Ariane Division noted that “Long before a draft opinion in Roe v. Wade was passed, some Supreme Court justices often used personal email accounts for sensitive transmissions rather than secure servers set up to protect such information.”, among other security flaws, not disclosed in the court report”.

“Supreme Court employees also used printers that did not generate logs – or were able to print sensitive documents off-site without tracking – and ‘burn bags’ to ensure safe destruction of materials were left open in hallways and unattended,” he says.
“New details released to CNN by multiple sources familiar with the court proceedings offer a more detailed picture of years of lax internal procedures that could have compromised security, led to leaks, and hampered criminal investigations,” the reporter said.
“It’s been going on for years,” said one former employee. Another said the judges are “not masters of data protection protocol.”
In May 2022, Politico published a leaked draft opinion for Dobbs v. Jackson Women’s Health, prompting nationwide protests and threats of violence from conservative justices in their homes.
During a segment on “Varney & Co.,” he expressed frustration and disbelief at how the Supreme Court’s investigation into leaking the Roe v. Wade draft decision failed to identify a perpetrator after interviewing more than 75 people in a months-long investigation.
That led to nationwide protests and threats of violence against conservative judges in their homes.
The Supreme Court released its report last month, which leaked the draft opinion, which overturned the court’s controversial precedent in Roe v. Wade on the “constitutional right” to abortion and returned the issue to the states.

An investigation into Politico last year ended without identifying the source of the leak:
The Supreme Court Marshal’s inquiry included a forensic investigation, but this “found no relevant information”. Marshall’s office determined that 82 employees had opinion exemptions and denied the publication of 97 employees’ opinions. Many have noted that it seems odd that none of the judges were interviewed in the investigation.
This is why the extraordinary betrayal of trust that occurred last May calls for a thorough investigation. The Chief Justice of the Supreme Court tasked Marshall and his staff.
After months of painstaking analysis of forensic evidence and interviews with nearly 100 employees, Marshall’s team determined that “82 employees [had] access to electronic or hard copies of the draft opinion.”Marshall’s Report of Findings and Recommendations 11 (January 19, 2023).

To follow up on all available leads, however, Marshall’s team conducted additional forensic analysis and conducted multiple follow-up interviews with specific employees. But the team has so far been unable to identify the person responsible by a preponderance of the evidence. Id., at 17. A public version of Marshall’s report is attached.
They also followed up on social media claims about who leaked the decision, but “investigators found nothing to substantiate any social media allegations.”
