Donald Trump ‘Expungement’ Coming Soon?
The two Trump impeachments were widely acknowledged to be partisan witch hunts.
In fact, attacks on President Trump have been so relentless for the past six years that they have lost their novelty and are backfiring. Some liberals have even started to sympathize with the 45th President.
On Thursday, two members of the GOP filed resolutions to expunge both impeachments from the record— Marjorie Taylor Greene (R-GA) and Elise Stefanik (R-NY).
The possibility of Donald Trump being “expunged” from the House of Representatives impeachment records is a complex legal issue with no easy answer. There is no clear legal precedent for expunging an impeachment, and there is disagreement among legal scholars about whether it is even possible.

Some legal experts argue that an impeachment cannot be expunged because it has an effect outside of the House. They point to the fact that the Senate trial was a separate proceeding from the House impeachment and that the Senate’s acquittal did not erase the fact that Trump was impeached.
Although it would take a change in the legislation, other legal experts think it is possible to get an impeachment thrown out. They contend that since Congress has the authority to alter its own procedures, the Constitution does not expressly forbid the erasure of an impeachment.
A motion to seal Trump’s impeachment records is presently being debated in the House of Representatives, which is controlled by Republicans. It’s unclear, though, if the resolution would have any legal significance.

To pass the resolution in the Senate, a vote would be required, and it is doubtful that enough Democrats would vote in favor of it.
Even if the House and Senate were to approve the resolution, it is not clear whether it would be upheld by the courts. The Supreme Court has never ruled on the issue of expunging an impeachment, and it is possible that the Court would find that such a resolution is unconstitutional.

In short, there is no simple legal solution to the question of whether President Trump might be “expunged” from the House of Representatives’ impeachment records. The House might approve a resolution to seal Trump’s impeachment records,
but it’s not clear if that would have any legal significance. In the end, the Supreme Court will determine whether or not an impeachment can be thrown out.
